UPDATE: April 11, 2008

Scott Boney is still hospitalized, but is expected to continue to improve. He has had about a half dozen surgeries and still has more to go. He is able to interact on a minimal level with visitors. There is no word on the progress of the lawsuit.

Scott Boney, a well-known San Diego, California grocer was critically injured, as reported to Cruise Bruise by a fellow passenger onboard the Carnival Elation.

Carnival Elation departed from San Diego early Monday September 17, 2007 evening and returned Saturday September 22.

The passenger tells Cruise Bruise, "I was on this Carnival Elation Cruise (9/17/07).  Scott Boney, owner of Windmill Farms, a grocery store in San Diego, was critically injured when another passenger pushed him down some stairs. 

According to other passengers I talked to, the other individual Mr. Boney did not know, and was intoxicated.  Carnival kept the person who did this in his room, guarded by a security guard, until taken away by the FBI in Cabo. The room he was kept in was E-120.  I know this because I asked the security person guarding the room about the person inside.

The man was traveling with a large group of friends. The description of the group of men is similar to the description of another group of men involved in an incident, the Dianne Brimble case.

The fellow passenger who allegedly pushed Boney down the stairs was named in a lawsuit. The lawsuit, filed in San Diego Superior Court, is  #37-2007-00075411-CU-PO-CTL, Elizabeth Boney Vs Caden McCray (McRay). It was filed by San Diego attorney Daniel Navigato September 21, 2007 seeking $50 million in general damages and $50 million in special damages.

Boney is stll in critical condition in Scripps Hospital.

The lawsuit, filed in San Diego Superior Court, is  #37-2007-00075411-CU-PO-CTL, Elizabeth Boney Vs Caden McCray (McRay), filed by San Diego attorney Daniel Navigato September 21, 2007 seeking $50 million in general damages and $50 million in special damages.

Family hopes when Boney wakes up he will be able to tell his side of the story, but that is highly unlikely. Head injury victims rarely remember the event that gave them the head injury. This is partially because drugs are given immediately after the incident, and continue on for days or weeks, that induce immobility and amnesia in a drug-induced coma state. The first few weeks after the head injury are very traumatic and painful. It is not something people would want to remember. So, drugs are given to produce immobility and amnesia in the patient. The induced coma keeps the patient immobile so brain healing can begin. Such a drug might be Propanol.

EDITOR'S NOTE:
Our own daughter was on the drug after her head injury, and now doesn't remember anything at all prior to day 36 of the recovery, though she was awake off and on from day 18.

We would like to stress at this point in time, Scott Boney and his traveling group broke one of our most important safety rules on Cruise Bruise. He was wandering the ship alone, at night. This scenario sets up the passenger for any number of incidents where he/she has no assistance from friends or family and no witnesses.

When roaming the ship do take a trusted partner with you, especially at night. Late night on the cruise ship claims the most amount of victims, with many of those incidents resulting in nothing but questions, no answers.
