The decedent, Steve Booth (“Steve” or “the decedent”), was a Carnival cruise ship passenger at the time of the accident, and he embarked on the ill-fated scuba excursion with the assistance of Carnival and Carnival’s agent, a Virgin Islands scuba instruction company.

The dive excursion company, Dive World Inc, run by Jeanne Bowen, and Michelle Skillman.

Booth participated in an introductory scuba diving course offered by Dive World on St. Thomas, U.S.Virgin Islands. The course was called “Discover Scuba Diving” and its purpose was to introduce scuba diving to persons with no previous scuba diving experience. Booth had no previous scuba diving experience.

During the course, Booth became separated from Skillman and other scuba divers and was soon found unconscious in the water. Resuscitation attempts failed, and Booth was pronounced dead shortly thereafter.

Legal action was brought against Bowen, as the owner of Dive World Inc, and Skillman, as an employee of Dive World.

Mr. Booth estate filed a lawsuite in state courts of Miami-Dade County1 on July 5, 2005. This wrongful death action, No. 07-10689,  stems from a fatal scuba diving accident that occurred on July 20, 2004, in the territorial waters of the U.S. Virgin Islands.

The suit was filed by Haggard, Parks, Haggard & Lewis and Jeannete C. Lewis and Robert L. Parks.
